Terms of Service

These Terms of Service (“Terms”) govern your use of the followly.cc platform (“followly”, “the Service”) operated by Followly (“we”, “us”, or “our”). By creating an account or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use followly.

Followly is an automated follow-up tool that helps photographers and service businesses send personalized follow-up reminder emails. You add client details and event dates, and we send automated emails on your behalf at the times you configure.

You must be at least 18 years old and capable of forming a binding contract to use followly. By using the Service, you represent that you meet these requirements.

You sign in via Google OAuth. You are responsible for maintaining the security of your Google account. You must not share your account or allow others to access it on your behalf.

You agree to provide accurate business information in your profile and to keep it up to date.

You agree not to use followly to:

• Send unsolicited commercial email (spam) or purchase email lists
• Harass, threaten, or defame any person
• Impersonate another person or business
• Send content that is illegal, harmful, or violates third-party rights
• Attempt to interfere with or disrupt the Service
• Reverse-engineer, decompile, or extract source code from the Service

You are solely responsible for the content of the emails sent through your account. You must have a lawful basis (such as a pre-existing business relationship or explicit consent) for emailing each recipient.

All emails sent through followly include an unsubscribe link as required by the Spam Act 2003 (Cth), CAN-SPAM (U.S.), and GDPR (EU) regulations. You must not circumvent or obscure this mechanism.

If a client unsubscribes or their email bounces, followly will automatically stop sending to that address. You must not attempt to re-add unsubscribed clients to circumvent this.

Followly offers a free trial period followed by a paid subscription. Billing is handled by Stripe. By subscribing, you authorise us to charge your payment method on a recurring basis until you cancel.

You may cancel your subscription at any time from the Settings page. Cancellation takes effect at the end of the current billing period — no partial refunds are issued for unused time. After cancellation, your account remains accessible but reminder sending is paused.

New accounts receive a free trial. You may only claim one trial per person. If we detect abuse (such as creating multiple accounts to extend trial access), we may terminate the accounts without notice.

You retain ownership of all client data you add to followly. We do not claim any intellectual property rights over your content. Our use of your data is governed by our Privacy Policy.

You can export or delete your data at any time. If you delete your account, all associated data is permanently removed.

We strive to keep followly available and reliable, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice. In the event of a permanent shutdown, we will provide at least 30 days' notice and the ability to export your data.

To the maximum extent permitted by law, followly and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of the Service.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that emails sent through followly will be delivered to every recipient's inbox. Delivery depends on factors outside our control, including recipient email providers and spam filters.

We may suspend or terminate your account if you violate these Terms, engage in abusive behaviour, or use the Service in a way that harms other users or our infrastructure. Where possible, we will provide notice and an opportunity to remedy the issue before termination.

You may delete your account at any time from the Settings page.

We may update these Terms from time to time. If we make material changes, we will notify you by email or by displaying a notice in the app at least 14 days before the changes take effect. Continued use of followly after the effective date constitutes acceptance of the updated Terms.

These Terms are governed by and construed in accordance with the laws of Australia. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Australia.

The Service is operated from Australia and is designed to comply with the Australian Privacy Act 1988, the Spam Act 2003 (Cth), and other applicable Australian law. Where you are located in another jurisdiction, the relevant provisions of GDPR, CAN-SPAM, and other applicable local laws also apply to the extent required.
